Member Terms and Conditions

Please read these Terms carefully before applying for or renewing membership.

1. Membership Agreement

By applying for and maintaining membership with Mekatron Flyers Club ("the Club"), all members agree to comply with these Terms and Conditions, the Club Regulations, Safety Procedures, and any instructions issued by Club management, safety officers, or authorised personnel.

2. Membership Categories

The Club offers the following membership categories. Benefits and privileges may vary by category:

  • Junior Member (10–17 years)
  • Youth Member (18–25 years)
  • Regular Member
  • Corporate Member

3. Membership Fees

3.1 Membership fees are payable in advance and must be kept in good standing at all times.

3.2 All membership fees are non-refundable, except where required by applicable law.

3.3 The Club reserves the right to review and amend membership fees upon reasonable notice to members.

4. Member Responsibilities

All members are required to:

  • Operate all aircraft safely, responsibly, and in accordance with Club regulations.
  • Conduct thorough pre-flight inspections before each flight.
  • Use only airworthy aircraft and equipment that meets Club standards.
  • Follow all instructions issued by Club officials and authorised personnel.
  • Report all incidents, accidents, injuries, fires, or unsafe conditions promptly to Club management.
  • Treat all members, guests, staff, and visitors with respect and courtesy.
  • Abide by Club Regulations and safety precautions.

5. Flying Operations

5.1 All flying activities must take place exclusively within designated flying zones.

5.2 Flying is permitted only during approved operating hours, unless otherwise authorised in writing by the Club.

5.3 Night flying is strictly prohibited unless specifically approved in advance by Club management.

5.4 Members must not operate any aircraft while impaired by alcohol, drugs, fatigue, illness, or any other condition that may adversely affect safe operation.

6. Aircraft Ownership and Liability

6.1 Members remain fully responsible for their aircraft, batteries, equipment, and accessories at all times.

6.2 The Club accepts no responsibility for the loss, theft, damage, or destruction of any member-owned property.

6.3 Members are personally liable for any damage, injury, or loss caused by their aircraft, equipment, actions, or negligence.

7. Insurance

7.1 Members are strongly encouraged to obtain appropriate personal liability insurance for their flying activities.

7.2 The Club may recommend insurance providers from time to time but does not guarantee coverage under any third-party policy.

7.3 Any Club insurance policy does not automatically extend coverage to individual members unless expressly stated in writing.

8. Training and Competency

8.1 The Club may require new members to complete an assessment, orientation, training programme, or competency evaluation before being authorised to fly independently.

8.2 Members must maintain safe operating standards at all times throughout their membership.

8.3 The Club reserves the right to suspend or restrict flying privileges where safety concerns are identified.

9. Junior Members

9.1 Members under the age of 18 must provide written consent from a parent or legal guardian prior to participating in Club activities.

9.2 Parents or guardians remain responsible for ensuring their child's compliance with all Club requirements and safety procedures.

10. Guest Policy

10.1 Guests may only participate in Club activities with prior written approval from Club management.

10.2 Members who introduce guests are fully responsible for their guests' conduct while on Club premises.

10.3 All guests must comply with applicable safety requirements and Club regulations.

11. Conduct and Behaviour

Members must not:

  • Engage in reckless, dangerous, or negligent flying.
  • Harass, threaten, intimidate, or abuse any person on Club premises.
  • Wilfully damage or misuse Club property or equipment.
  • Act in a manner that brings the Club into disrepute.
  • Disregard or ignore safety instructions issued by authorised personnel.

12. Suspension and Termination

The Club reserves the right to suspend, restrict, or terminate membership where a member:

  • Violates Club rules, regulations, or safety procedures.
  • Creates or contributes to a safety hazard.
  • Fails to comply with directions issued by authorised personnel.
  • Engages in conduct that is detrimental to the Club or its members.

Termination of membership does not entitle the member to a refund of any fees paid.

13. Incident Reporting

Members must immediately report the following to Club management:

  • Any personal injuries sustained during Club activities.
  • Property damage involving aircraft or Club equipment.
  • Aircraft collisions, fly-aways, or loss of control incidents.
  • Fires or battery-related incidents.
  • Any occurrence that may affect safety or give rise to an insurance claim.

14. Photography and Media

By accepting these Terms, members grant the Club permission to use photographs, videos, and recordings captured during Club activities for promotional, educational, and marketing purposes. Members who wish to opt out of this arrangement must provide written notice to the Club.

15. Amendments

The Club reserves the right to amend these Terms and Conditions, Club Regulations, and operating procedures from time to time. Members will be notified of any significant changes in a timely manner.

16. Acceptance

By signing the Membership Application Form, the member confirms that they have read, understood, and agree to be bound by these Terms and Conditions and all applicable Club Regulations.

Liability Waiver and Assumption of Risk Agreement

Important Notice

Participation in model aviation, unmanned aircraft systems (UAS), radio-controlled aircraft operations, flight demonstrations, training activities, simulator sessions, aircraft maintenance, and related Club events involves inherent risks that may result in property damage, personal injury, serious injury, or death. By signing this agreement, the participant acknowledges these risks and agrees to the terms set out below.

1. Assumption of Risk

I acknowledge that participation in activities organised, supervised, facilitated, or conducted by Mekatron Flyers Club ("the Club") involves inherent risks, including but not limited to:

  • Aircraft crashes and mid-air collisions.
  • Equipment malfunction or unexpected failure.
  • Battery fires, thermal runaway, and electrical hazards.
  • Personal injury caused by aircraft, propellers, tools, or equipment.
  • Damage to personal or third-party property.
  • Weather-related and environmental hazards.
  • Injuries sustained while operating, handling, transporting, assembling, repairing, or maintaining aircraft and equipment.

I voluntarily choose to participate in Club activities and fully assume all risks associated with such participation.

2. Release of Liability

To the fullest extent permitted by law, I hereby release and discharge the following parties from any and all claims, demands, actions, liabilities, damages, losses, costs, or expenses arising from my participation in Club activities:

  • Mekatron Flyers Club
  • Mekatron & Persones Ltd.
  • Club officers, directors, employees, and volunteers
  • Instructors and safety officers
  • Landowners, event organisers, sponsors, and partners

This release shall not apply where loss or injury results directly from gross negligence or wilful misconduct on the part of the Club or its representatives.

3. Responsibility for Aircraft and Equipment

I understand and agree that:

  • I am solely responsible for my aircraft, batteries, chargers, tools, accessories, and all related equipment at all times.
  • The Club is not responsible for the loss, theft, damage, or destruction of my property.
  • Any repairs, storage, transportation, or handling of my equipment by Club personnel is undertaken entirely at my own risk.

4. Damage to Third Parties

4.1 I accept full personal responsibility for any damage, injury, loss, or claims arising from the operation or ownership of my aircraft and equipment.

4.2 I agree to indemnify and hold harmless the Club and its representatives from any and all claims arising from my actions, negligence, equipment, or aircraft operations.

5. Compliance with Club Rules

I agree to:

  • Follow all Club regulations and safety procedures at all times.
  • Comply with all instructions issued by authorised Club personnel.
  • Operate aircraft only within approved flying areas and during approved operating hours.
  • Conduct thorough pre-flight inspections before each flight.
  • Immediately cease all operations when instructed to do so by a safety officer or Club official.

Failure to comply with these obligations may result in the immediate suspension or permanent termination of membership privileges.

6. Medical Fitness

6.1 I confirm that I am physically and mentally capable of safely participating in Club activities.

6.2 I agree not to participate while under the influence of alcohol, illegal drugs, any medication that may impair judgement, or any physical or mental condition that may affect safe operation.

7. Emergency Medical Treatment

7.1 In the event of an emergency, I authorise the Club to obtain appropriate medical assistance on my behalf where reasonably necessary.

7.2 I understand that any costs associated with emergency medical treatment remain my sole responsibility.

8. Photography and Media Consent

8.1 I grant the Club permission to use photographs, videos, recordings, or other media captured during Club activities for promotional, educational, training, marketing, and archival purposes.

8.2 I may withdraw this consent at any time by providing written notice to the Club.

9. Minors (Participants Under 18 Years of Age)

Where the participant is under 18 years of age:

  • A parent or legal guardian must sign this agreement on behalf of the minor.
  • The parent or guardian accepts full responsibility for the minor's participation in Club activities.
  • The parent or guardian agrees to be bound by all terms of this waiver on behalf of the minor.

10. Governing Law

This agreement shall be governed by, and interpreted in accordance with, the laws of the Federal Republic of Nigeria. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the Nigerian courts.

11. Acknowledgement

By signing below, I confirm that:

  • I have read and fully understood this agreement.
  • I am aware of the risks inherent in participating in Club activities.
  • I understand that I am voluntarily waiving certain legal rights by signing this document.
  • I sign this agreement freely and without coercion.
